Terms of Service

These Terms of Service (“Terms”) govern your access to and use of 3dAIAnimation’s website, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

3dAIAnimation provides an AI-powered platform that generates 3D humanoid animations from text descriptions. Our Service allows you to create, preview, and export animations in various formats including FBX, glTF, Blender, and others. The Service is provided on a subscription basis with different tiers offering varying levels of access and features.

You must be at least 13 years old (or 16 in the EU) to use the Service. If you are under 18, you must have permission from a parent or guardian. By using the Service, you represent and warrant that you meet these requirements.

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or violates these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates any applicable law or regulation
• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service to create animations depicting real, identifiable individuals without their consent
• Reverse engineer, decompile, or attempt to extract the source code of our AI models or software
• Use automated systems or bots to access the Service in a manner that sends more requests than a human can reasonably produce
• Resell or redistribute the Service without our express written permission
• Remove or alter any copyright, trademark, or other proprietary notices

Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your plan). You authorize us to charge your payment method on a recurring basis until you cancel your subscription.

Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No refunds will be provided for partial billing periods.

Price Changes

We reserve the right to modify our pricing. We will provide at least 30 days’ notice of any price changes. Your continued use of the Service after the price change takes effect constitutes your agreement to pay the modified amount.

Refunds

We offer refunds within 14 days of your initial purchase if you are not satisfied with the Service. For annual subscriptions, refunds after 14 days will be prorated based on unused time. Refunds are issued to the original payment method within 5-10 business days.

Your Content

You retain all ownership rights to the animations you generate using our Service. By using the Service, you grant us a limited, worldwide, non-exclusive license to use, reproduce, and display your content solely for the purposes of providing and improving the Service, including training our AI models. We may anonymize and aggregate your content for analytical and improvement purposes.

Our Content

The Service and its original content (excluding your generated animations), features, and functionality are owned by 3dAIAnimation and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or software.

Commercial Use

Depending on your subscription tier, you may use animations generated through our Service for commercial purposes. Free tier users are granted personal use licenses only. Please review your specific plan details for commercial use rights.

We reserve the right to review, moderate, and remove any content that violates these Terms or is otherwise objectionable. We employ automated systems and human review to detect prohibited content. While we strive to maintain a safe platform, we do not pre-screen all content and cannot guarantee that all content will comply with these Terms.

Service “As Is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3DAIANIMATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless 3dAIAnimation and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any person or entity.

The Service may contain links to third-party websites or services that are not owned or controlled by 3dAIAnimation. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon account termination, we will delete your personal information in accordance with our Privacy Policy, though we may retain certain data for legal or operational purposes.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California, and judgment on the award may be entered in any court having jurisdiction.

You agree to waive your right to participate in a class action lawsuit or class-wide arbitration. However, if you are a resident of the EU, you may have additional rights under applicable consumer protection laws.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. If you are a consumer based in the EU, you may also have rights under your local consumer protection laws.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the “Last updated” date. For significant changes, we will provide additional notice via email or a prominent notice on our Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
